Unlike no-fault states, Idaho uses a traditional fault-based system for car accidents. When you are injured in an Idaho auto accident caused by another driver, you file a claim directly against that driver. You need liability insurance for medical bills, lost wages, vehicle damage, and pain and suffering. You are not required to first exhaust your own personal injury protection coverage. This system puts responsibility squarely on the at-fault driver. It also means insurance companies aggressively dispute liability and damages to protect their bottom line.
Establishing fault requires gathering evidence such as the official police report filed by the Idaho State Police or Boise Police Department. You need witness statements, photos from the accident scene, traffic camera footage, and expert reconstruction analysis in complex crashes. BAM Injury Law handles all of this investigation while you focus on your medical recovery. The stronger the evidence of the other driver's fault, the stronger your leverage in settlement negotiations with their insurer.
Idaho Code section 6-801 establishes the state's modified comparative fault doctrine. Under this rule, your ability to recover damages depends on your share of fault for the accident. If you are found to be 49 percent or less at fault, you can still recover damages. On the other hand, the total amount you receive is reduced by your percentage of fault. If you are found to be 50 percent or more at fault, you are barred from any recovery against the other driver.
Insurance adjusters use comparative fault arguments as a standard tactic to reduce settlement offers. They may claim that you were speeding, failed to yield, or were distracted. Even when these allegations are not supported by the evidence. An experienced Idaho car accident lawyer at BAM Injury Law knows how to counter these arguments. The firm backed it with evidence and legal analysis. Protecting you from inflated fault assignments is one of the most important things an attorney can do for your case.
Among the most common accident types on Boise's Eagle Road corridor and the Interstate 84 Nampa interchange. It can frequently cause whiplash injuries, cervical disc herniations, and traumatic brain injuries. These injuries may not produce severe symptoms immediately. On the other hand, they can cause chronic pain, memory problems, and reduced quality of life for months or years. Side-impact T-bone crashes at Idaho intersections often produce more severe injuries. These are fractured ribs, spleen and liver injuries, and head trauma due to the limited side protection in most vehicles.
Though less common, they produce the most catastrophic injuries in Idaho car accidents. The combined closing speed of both vehicles doubles the impact force. Injuries in these crashes often include traumatic brain injury, spinal cord damage, severe burns, and traumatic amputations. Documenting your injuries from the first day with medical records from a Boise or Meridian hospital, urgent care, or physician is essential to your personal injury claim.
Idaho requires all drivers to carry at least $25,000 per person and $50,000 per accident in bodily injury liability coverage, along with $15,000 in property damage liability under Idaho Code section 49-1229. These minimums are frequently inadequate when serious injuries are involved. A single emergency room visit, surgery, and several weeks of physical therapy can easily exceed $25,000. When the at-fault driver's policy limits are insufficient to cover your losses, other coverage sources must be explored.
Your own uninsured and underinsured motorist coverage, known as UM/UIM coverage, may provide additional compensation when the at-fault driver has no insurance or too little insurance to cover your damages. Medical payments coverage on your own policy can help cover immediate medical bills regardless of fault. BAM Injury Law identifies and pursues all available insurance coverage, including umbrella policies and employer commercial auto coverage when the at-fault driver was on the job in the Boise or Meridian area.
After reporting your accident to your insurer and the at-fault driver's insurer, an adjuster will be assigned to investigate the claim. The adjuster's job is to minimize the payout, not to fairly compensate you. Initial settlement offers from Idaho insurance companies are almost always far below the actual value of serious injury claims. Accepting an early settlement releases the insurer from all future liability, meaning you cannot seek additional compensation even if your medical condition worsens.
BAM Injury Law handles all communications with insurance adjusters, responds to requests for documentation, and advises you when medical treatment has stabilized enough to accurately calculate your total damages before any settlement is finalized. If the insurer refuses to make a fair offer, BAM Injury Law files a lawsuit in Ada County District Court, Canyon County District Court, or the appropriate Idaho court and pursues full compensation through the litigation process. The threat of trial often motivates insurers to substantially increase their settlement offers.
Economic damages in Idaho car accident cases include past and future medical expenses, costs of physical therapy and chiropractic care, lost wages from work missed during recovery, reduced future earning capacity if your injuries affect your ability to work, and vehicle repair or replacement costs. Non-economic damages include compensation for physical pain, emotional suffering, anxiety, depression, and loss of enjoyment of activities you could perform before the accident.
Punitive damages under Idaho Code section 6-1604 may be available in cases involving drunk driving, street racing, or other extreme recklessness. These damages are uncommon but can substantially increase total recovery in appropriate Idaho cases. BAM Injury Law evaluates whether punitive damages are available in your case from the outset and builds the record needed to support them.
