Who Pays Medical Bills After a Car Accident in Utah?


After a car accident in Utah, your own Personal Injury Protection (PIP) insurance pays your medical bills first, regardless of who caused the crash. Utah is a no-fault state, which means your medical costs go through your own policy up to your PIP limit before the at-fault driver's insurance pays anything. Understanding how this works prevents you from being left with unpaid bills while your claim is pending.

Your PIP Coverage Pays First

Utah requires all drivers to carry at least $3,000 in Personal Injury Protection coverage. PIP pays your medical bills and 85% of lost wages (up to $250 per week) for injuries you sustain in a car accident, regardless of fault. PIP pays quickly, without requiring you to prove who caused the accident.

If your medical bills exceed your $3,000 PIP limit, your health insurance takes over. If you do not have health insurance, you may be able to negotiate medical liens where providers treat you and agree to be paid from your eventual settlement.

The At-Fault Driver's Liability Insurance

Once your medical expenses exceed Utah's $3,000 no-fault threshold, or once you sustain a qualifying serious injury (fracture, permanent impairment, permanent disfigurement), you can make a claim against the at-fault driver's liability insurance. The at-fault driver's insurer does not pay your bills directly during treatment -- it pays a lump sum settlement or judgment that reimburses you for all past and future medical costs, as well as pain and suffering.
