What are my rights as a pedestrian injured in a car accident in Utah?

Utah law gives pedestrians the right of way in marked crosswalks and at intersections. A driver who fails to yield to a pedestrian in a crosswalk or who runs a red light and strikes a pedestrian is at fault for the resulting injuries. Because pedestrians have no vehicle protection, crash injuries tend to be severe.

Under Utah's no-fault system, injured pedestrians may access PIP (Personal Injury Protection) benefits through their own auto insurance policy if they have one. If you do not own a vehicle, you may be able to access PIP through a household member's policy. If PIP is unavailable, you proceed directly against the at-fault driver's liability insurance.

Utah's comparative fault rule (Utah Code Section 78B-5-818) allows you to recover compensation as long as you are not more than 50 percent at fault for the crash. If you were partially at fault -- for example, crossing outside a crosswalk -- your compensation is reduced by your percentage of fault.

The statute of limitations for pedestrian accident injury claims in Utah is four years from the date of the crash under Utah Code Section 78B-2-307.
