What is premises liability and when can I recover for injuries in Utah?

Premises liability is the area of law that governs injuries that occur on another person's or business's property. Property owners and occupiers have a legal duty to maintain reasonably safe conditions for people who enter their property. When they fail to do so and someone is injured as a result, the property owner may be liable for the victim's damages.

Utah courts recognize different categories of visitors, and the duty owed varies by category. An invitee (a customer in a store, for example) is owed the highest duty of care: the owner must actively inspect for and fix hazardous conditions. A licensee (a social guest) is owed a duty to warn of known hazards. A trespasser is generally owed only the duty not to set intentional traps.

Common premises liability claims in Utah include: slip and fall accidents on wet or icy surfaces, injuries from broken stairs or handrails, inadequate lighting in parking lots or stairwells, swimming pool accidents, and dog bites on private property.
