What can I do if I was injured in a hit-and-run accident in Utah?

If the driver who hit you fled the scene, you still have options for recovering compensation. Your primary source is your own uninsured motorist (UM) coverage. Under Utah law, a hit-and-run driver is treated as an uninsured motorist for purposes of UM coverage. If you carry UM coverage on your own policy, you can file a claim with your own insurer.

Utah requires that the hit-and-run accident be reported to the police. File a police report as soon as possible. Check for surveillance cameras in the area, dashcam footage from nearby vehicles, and eyewitnesses who may have seen the fleeing vehicle's license plate. This evidence can help identify the driver and may allow you to pursue a direct claim against them.

Utah also requires that you report the accident to your insurance company promptly. Failure to report in a timely manner can complicate your UM claim. Do not give a recorded statement to your insurer before speaking with an attorney.

Utah's statute of limitations for hit-and-run injury claims is four years from the date of the crash under Utah Code Section 78B-2-307. However, UM policies often have shorter contractual notice requirements.
