How the Contingency Fee Works

A contingency fee means the attorney's payment is contingent on you winning. If the case results in no recovery, the attorney collects no fee. If the case settles or you win at trial, the attorney takes an agreed-upon percentage of that recovery.

  • You are injured in a car accident.
  • You call a personal injury attorney and schedule a free consultation.
  • You sign a fee agreement that spells out the percentage the attorney will take if you win.
  • The attorney works your case. You owe nothing while the work is happening.
  • If the case settles or you win at trial, the attorney takes their percentage from that amount.
  • If the case produces no recovery, you owe the attorney no fee.

What Percentage Do Utah Personal Injury Attorneys Charge?

  • Pre-litigation: 33% of the total recovery.
  • Post-filing: 40% of the total recovery.
  • Trial/appeal tier can reach 45% or higher.

What Costs Are Separate from the Attorney Fee?

Case expenses (filing fees, medical records, expert witnesses, depositions, investigation) are separate from the attorney fee. BAM advances these costs on your behalf. Those advanced costs are reimbursed from your settlement. Ask about the case-cost policy if the case is lost before you sign.

The Math: Does Hiring a Lawyer Actually Cost You Money?

Scenario: Car accident, soft tissue injuries, moderate property damage.

Without an attorney: adjuster offers $20,000. Net to you: $20,000.

With an attorney: case settles for $50,000. Fee at 33% = $16,500. Case costs = $1,000. Net to you: $32,500. That is $12,500 more than without representation, even after paying the fee.

What Happens If You Lose?

Questions to Ask Before Signing

Utah Rule of Professional Conduct 1.5 requires contingency fee agreements to be in writing with the percentage clearly stated at each stage. Ask:

  3. Does the percentage change at trial or appeal?
  4. Who advances case costs?
